Earlier on Wednesday, Avenatti dropped his request to participate in the court battle tied to the FBI raid of Cohen's hotel and office after a federal judge said that in order to be admitted into the NY proceedings, he would need to "stop your publicity tour".
Stephen Ryan, an attorney for Cohen, argued that Avenatti had acted outrageously by publicly releasing banking information related to Cohen and by criticizing Cohen in dozens of television appearances.
Daniels, who was not at the hearing, was paid $130,000 by Cohen before the 2016 election to keep silent about an alleged 2006 affair with Trump. Ryan protested that the barrage was improper, saying Avenatti was on television at least 170 times, mostly to badmouth Cohen. The next court date in his case is set for Wednesday morning.
Hendon then blasted Avenatti's court filing stating that Egan Avenatti was not the law firm for Daniels' as "carefully constructed" and "misleading".
The files, mostly from phones and electronic storage devices, were seized April 9 in raids on Cohen's Manhattan home and office. Federal prosecutors have already received more than 292,000 documents so far, with Cohen, Trump and the Trump Organization claiming that 252 documents are privileged. Avenatti has taken to Twitter in current weeks to accuse each Cohen and Trump of varied types of corruption unrelated to the civil case Daniels filed towards Trump in California, and he has sought to intervene within the federal case towards Cohen in NY whereas utilizing courtroom appearances to proceed his public campaign towards them. There is now a Treasury Inspector General investigation into Cohen's release of the Suspicious Activity Report (SAR), Ryan told the court. Wood was nonplussed by Avenatti's colorful and impassioned rhetoric, which included his assertion that he has been "an exemplary member of the bar for 18 years" with an "exceptional track record".
Trump renews China tariff threat, complicating talks
But on Wednesday, Trump reversed and signaled that he still planned to impose $ 50 million in tariffs on Chinese imports . Commerce Secretary Wilbur Ross is scheduled to be in Beijing on June 2 to 4 for the latest round of negotiations.
"I was told to pull up a seat and share this table", Avenatti said with a chuckle before sitting down.
In response, Cohen's attorney said he was unaware of the release of any audio file, noting that if it had been released, they would be "everywhere" and that "if" the audio files existed, they would be "under lock and key at my law firm".
"Candidly, he shouldn't be asking us to answer questions; he should be asked to answer questions", Ryan said. He accused Cohen's lawyers of leaking the audio. The judge ruled Wednesday that Cohen's attorneys' review of the materials must be concluded by June 15, or the remaining materials will be sent to a group of lawyers not connected to the case. Daniels, whose real name is Stephanie Clifford, has also filed suit against Cohen, claiming a non-disclosure agreement she struck with Trump is null and void.
Rachel Maimin, an assistant US attorney, said her office was still trying to access files from two Blackberry devices, which Cohen believed belonged to his wife almost a decade ago, and the contents of a shredding machine. By Ryan's count, Avenatti made at least 170 TV appearances and Ryan said he attacked Cohen in majority. Avenatti's firm holds a 75 percent stake in Eagan-Avenatti while Michael Eagan holds a 25 percent stake in said firm, according to documents obtained by Finnegan. He withdrew his motion to join a short time later. The judge told him that if he is allowed to participate in the process, he would "not be permitted to use this court as a platform for anything" and said he could no longer declare that Cohen is guilty of potential charges.
