Armed homeowner shot by Colorado police after killing intruder

The unidentified man was killed by the Aurora Police Department (APD) after he shot an intruder in his home.

Police were called to an address on East Montview Boulevard on a report of someone breaking into a home.

When they arrived, officers say they heard gunshots and were approached by a man with a gun. A man driving a stolen truck was shot dead after he rammed several police cruisers, the Denver Post reported. It wasn't until later that investigators discovered the man lived inside the home.

The child suffered serious injuries, but they're not considered life-threatening.

Aurora police haven't said whether Black was inside his home or outside it when he was shot.

The police arrived on a call made by a woman who said a man broke into her house, according to the police Department of Aurora. "We are providing assistance through our victim advocates to help the family of the deceased resident through this very hard time".

The argument follows his legal team's December filing to appeal Turner's case , arguing that it was "fundamentally unfair". Alaleh Kianerci, the district attorney who successfully prosecuted Turner's case, was present for Tuesday's hearing.

The investigation is being handled by the Aurora Police Major Crimes Unit and Denver Police Department.

The officer who fired his weapon has been placed on administrative reassignment with pay, according to the news release.

The armed man, however, was identified as Richard "Gary" Black Jr.by Siddhartha Rathod, a lawyer representing his family's estate.

Findings will be turned over to the 17th Judicial District Attorney's Office, which will determine whether any criminal charges will be filed against any involved person, the office said in a release.
