States going to court to challenge mileage rule

California and 18 other states said they would sue to stop the Trump administration proposal to weaken Obama-era federal fuel efficiency standards, arguing the United States has an obligation to protect the environment for future generations. That would price many buyers out of the new-vehicle market, forcing them to drive older, less-safe vehicles that pollute more, the administration says. The government also said the proposal will save consumers $2,340 (£1,796 / €2,017) since automakers won't have to increase prices to offset the costs of building more efficient vehicles.

The Corporate Average Fuel Economy standards require automakers' cars to average about 50 miles per gallon by 2025.

The administration also wants to limit states' rights to make their own standards, to which California and several other states have already said, We'll see you in court.

At press time, only Fiat Chrysler Automobiles had responded to the proposed rules: "The proposal includes a range of options, and we will carefully evaluate how each aligns with FCA's goals of continuous improvement in vehicle efficiency and, at the same time, building vehicles customers want, at prices they can afford". It's likely to set up a lengthy legal battle between California and the Trump administration.

"The source of the safety benefits from the analysis for this proposed rule is getting folks into affordable, more fuel-efficient, cleaner, safer cars", King told reporters.

The Trump administration has served notice that it plans to roll back tough gas mileage standards scheduled for 2021 by the Obama administration. The result, opponents say, will be dirtier air and more pollution-related illness and death.

Becerra said California is "ready and willing" to talk with Trump administration regulators, but that previous talks have not been fruitful.

Environmental groups in ME, which is among the states that adopted California's tougher emissions requirements for new cars, and around the country quickly denounced the widely anticipated move.

The newly proposed CAFE standards are thus good news to consumers, according to astatement from Myron Ebell, the director of CEI's Center for Energy and Environment.

The Alliance of Automobile Manufacturers, a main industry group, sought to stave off any dispute between California and the federal government that could split the USA auto market: "We urge California and the federal government to find a common sense solution that sets continued increases in vehicle efficiency standards while also meeting the needs of American drivers".

The administration's rule aims to preempt California's Clean Air Act (CAA) waiver and argues that it should be pulled entirely.

In 2012, when the standards were first adopted, cars were about 50 per cent of new-vehicle sales.
